Shadden ORDINANCE NO. 9975 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 7444 MIN-TOM DRIVE, BEING ON THE SOUTHWEST LINE OF MIN-TOM DRIVE AT KELLEY ROAD, FROM R-1 RESIDENTIAL ZONE TO RT-1 RESIDENTIAL TOWNHOUSE ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 7444 Min-Tom Drive, being on the southwest line of Min-Tom Drive at Kelley Road. Tracts 13 and 14, Varnell Farms, as shown by plat of record in plat book 12, page 17, ROHC; being the properties described in plat book 3103, page 890, ROHC, and deed book 3119, page 656, ROHC. Tax Map No. 149A-C-7 and 8. from R-1 Residential Zone to RT-1 Residential Townhouse Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Subject to a 25' natural sight-obscuring screen and buffer or a 6' sight-obscuring wooden fence or wall along the south, east, and west lines of said tract. 2. Subject to approval of access plan by City Traffic Engineer. 3. No back-out parking onto Min-Tom Drive. 4. All existing easements are retained. 5. At the time of the development of the tract, the developer will erect a wooden 6-foot high fence along that portion of the east line of the property which adjoins Ashwood Subdivision. 6. No pools or tennis courts or other community recreational facilities will be placed between the townhouses built along the eastern end of the development and Ashwood Subdivision. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
